The evangelical-led\u00a0Trump<\/strong>\u00a0administration has been waging a war against transgender people since 2016, but the way they responded to a Supreme Court case involving anti-trans discrimination may be the most horrifying defense of bigotry yet.<\/p>\n

The case in question involves\u00a0Aimee Australia Stephens<\/strong>, a transgender woman, who spent six years working as a funeral director and embalmer in Detroit. In 2013, she told her colleagues and employers at RG & GR Harris Funeral Home that she would go through sex-reassignment surgery so that her outward appearance matched her true gender.<\/p>\n

The proper response would have been, \u201cWe wish you the best.\u201d Or maybe \u201cWe can\u2019t wait to have you back at work!\u201d Or maybe \u201cThis is none of my goddamn business, but more power to you.\u201d<\/p>\n

Instead, owner\u00a0Thomas F. Rost<\/strong>\u00a0fired her.<\/p>\n

Stephens later filed a lawsuit against her employer with two specific allegations: that the company violated Title VII of the Civil Rights Act of 1964 by firing her for being transgender, and that they violated sex discrimination laws by saying she was fired\u00a0for refusing to wear a suit (which was required of all\u00a0male<\/em>employees). The first allegation was rejected altogether because a court said discrimination on the basis of gender identity was\u00a0not<\/em>\u00a0banned by Title VII, so you couldn\u2019t argue otherwise. The second one has been the basis of a lengthy legal battle.<\/p>\n

In 2016, a federal judge said the funeral home didn\u2019t violate the law by firing an employee who wanted to dress as a woman. While discrimination could be argued, the judge said, the employer\u2019s religious rights allowed for it under the law. To put it another way, the employers\u2019 faith, which compelled them to make men wear suits at work, was deemed more important than the right of a female employee to not wear a suit.<\/p>\n

An appeals court later (thankfully) overturned that ruling. They said Stephens was a victim of discrimination and that her wanting to wear a dress didn\u2019t burden her employers enough that the religious trump card kicked in.<\/p>\n

Now the Supreme Court\u2019s going to weigh in, and the Trump administration\u00a0issued a brief\u00a0calling for SCOTUS to overturn the ruling. They want religious business owners to have the right to fire transgender employees. Just because. But they\u2019re going even further by calling for the Supreme Court to make sex discrimination legal regardless of what Title VII says.<\/p>\n

In short, the government is saying that when Title VII prohibits sex discrimination, it really means \u201cbiological sex.\u201d So firing trans people at will ought to be totally fine.<\/p>\n

Dominic Holden<\/strong>\u00a0at\u00a0BuzzFeed explains\u00a0that this is all coming from the Christian Right\u2019s playbook:<\/p>\n

The administration\u2019s argument against LGBTQ rights\u00a0matches the advocacy of conservative Christian groups<\/strong>, which claim Congress only intended to ban discrimination because someone is male or female \u2014 saying the sexes cannot be treated differently.\u00a0Their argument says interpreting the term \u201csex\u201d more broadly effectively rewrites the law, and only Congress, not courts, has that license.<\/strong><\/p>\n

The counterargument from LGBTQ advocates and several lower courts, however, is that the intent of lawmakers does not limit a law\u2019s reach, but rather its meaning is defined by the statute\u2019s plain text.\u00a0They say anti-transgender discrimination can result from a person defying traditional sex stereotypes or because the person transitioned from one sex to another \u2014 and thus, it is inherently a type of sex discrimination.<\/strong><\/p>\n<\/blockquote>\n

That latter argument makes sense. Stephens was fired for, say, wanting to wear a dress, but a cis woman who wanted to wear a\u00a0dress would still have a job. Stephens was fired, then, for not fitting a gender-based stereotype. That\u2019s sex discrimination. It\u2019s like firing a woman for having short hair.<\/p>\n

If the government gets its wish \u2014 which is to say, if white evangelical Christians get their wish \u2014 then it could become open season for Christian business owners to fire transgender people for the crime of merely existing. (In which case the rest of us should openly refuse to do business with bigoted owners \u2014 and to make sure the world knows which businesses are run by those people.)<\/p>\n

If all that wasn\u2019t enough, a\u00a0separate brief\u00a0filed by the Christian hate group Alliance Defending Freedom took a\u00a0\u201csky is falling\u201d approach\u00a0to what the country would look like if you\u00a0couldn\u2019t<\/em>\u00a0fire trans people.<\/p>\n

\u201cIt will deny women and girls fair opportunities to compete in sports<\/strong>, to ascend to the winner\u2019s podium, and to receive critical scholarships,\u201d the ADF brief states. \u201cIt will also require domestic-abuse shelters to allow men to sleep in the same room as female survivors of rape and violence<\/strong>. And it may dictate that\u00a0doctors and hospitals provide transition services<\/strong>\u00a0even in violation of their religious beliefs.\u201d<\/p>\n

The people who have earned a reputation for not giving a damn about\u00a0anyone who doesn\u2019t think just like they do want you to believe\u00a0they now care about the whole world<\/em>. (Also, I assure you no trans person has ever forced a doctor to perform a transition service against his or her will. That sounds\u2026 like a horrible idea.)<\/p>\n

The oral arguments for this case and two others that involve similar issues will occur in early October. Given the Court\u2019s makeup, there\u2019s no reason to be optimistic about what the justices will do.<\/p>\n

Never vote for a Republican. The GOP\u2019s only policy goal is to inflict pain on people who disagree with them. LGBTQ people will suffer more than most, and this is just the latest example of it.<\/p>\n
